Terms of Service

1. Agreement

By creating an account or using SubmitKit (“Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, visitors, and others who access the Service.

2. Description of Service

SubmitKit provides a hosted form-backend service: it receives HTML form submissions on your behalf, stores them, and delivers notifications. You integrate it by pointing your form's action attribute at a SubmitKit endpoint.

3. Accounts

• You must provide a valid email address.
• You are responsible for maintaining the security of your account and API keys.
• You must be at least 16 years old to use the Service.
• One person or legal entity may not maintain more than one free account.

4. Acceptable use

You may not use the Service to:

• Collect data without the knowledge or consent of the people submitting it.
• Transmit spam, malware, or illegal content.
• Circumvent submission limits through multiple accounts or automated abuse.
• Resell or sublicense access to the Service.
• Collect sensitive data such as payment card numbers, social security numbers, or health information without explicit written permission.

5. Subscription and billing

• Paid plans are billed monthly in advance via Stripe. All prices are in EUR and exclude applicable taxes.
• Your subscription renews automatically. You may cancel at any time from your account settings; access continues until the end of the current billing period.
• We reserve the right to change pricing with at least 30 days' notice to existing subscribers.

6. Refunds

Monthly subscriptions are non-refundable except where required by applicable law. If you believe a charge was made in error, contact [email protected] within 14 days of the charge.

7. Data and privacy

Our Privacy Policy governs how we handle personal data. As a user, you are the data controller for submissions collected through your forms; SubmitKit acts as a data processor on your behalf.

8. Service availability

We aim for high availability but make no uptime guarantee. The Service is provided “as is” without warranties of any kind. We are not liable for any loss of data or revenue arising from downtime.

9. Termination

We may suspend or terminate accounts that violate these Terms. You may delete your account at any time from account settings. Upon termination, your data is deleted within 30 days.

10. Limitation of liability

To the maximum extent permitted by law, SubmitKit's total liability for any claim arising from use of the Service is limited to the amount you paid us in the three months preceding the claim.

11. Changes to these Terms

We will notify account holders by email at least 14 days before any material changes take effect. Continued use of the Service after that date constitutes acceptance.
